Fresh policies come into force in November

VGP – A series of new legal documents came into effect in November, 2013, including new ID cards, conditions on overseas work permit, regulations on illegal marriage, sanctions for fishery violations and administrative violations in atomic power.

New ID cards have no parent names

Decree 106/2013/ND-CP amending Decree 170/2007/ND-CP, dated November 19, 2007, regulates that new ID cards are issued without names of the cardholder’s parents.

Under the new Decree which took effect on November 2, 2013, the time of ID card issuance is reduced to no more than 20 days in mountainous, border and island areas and 15 days in lowland areas.

Five conditions required for overseas work permit

According to Decree No. 102/2013/ND-CP which will become effective on November 11, 2013, foreigners who want to be granted a work permit are required to meet the five following conditions: (1) they must have enough civil capability according to Vietnamese laws; (2) they must be in a health condition suitable for the jobs they want to do; (3) they must be mangers, managing directors or technical workers; (4) they must not be offenders or those who are held criminally responsible under Viet Nam’s or foreign countries’  laws; and (5) they must obtain written approval of a State agency in charge of employment of foreigners.

Each work permit is now valid a maximum of two years (currently it is three) and will be withdrawn upon expiration. If a business needs to employ a foreign worker continuously, it must apply for the reissuance of work permit for the person.

The Decree replaces Decree No. 34/2008/ND-CP dated March 25, 2008 and Decree No. 46/2011/ND-CP dated June 17, 2011 on employment and administration of foreigners working in Viet Nam.

New regulations on illegal marriage

According to Decree No. 110/2013/ND-CP dated September 24, 2013 on sanctions for administrative violations in the field of judicial assistance, judicial administration, marriage and family, civil judgment enforcement, enterprise and cooperative bankruptcy, people who are married but living as husband and wife with another person, being single but living as husband and wife with another person known as married person will be punished VND1-3 million.

A fine of between VND 500,000-1,000,000 shall be imposed for the acts of under-age marriages.  

The Decree will take effect on November 11, 2013. 

Sanctions for fishery violations

Under Decree 103/2013/ND-CP, stipulating the handling of administrative violations in fisheries activities, violators may face a fine of between VND 3-5 million for storing or transporting electric shock tools on fishing vessels or other floating facilities.

A fine of between VND 80 million and 100 million will be imposed for the acts of exploiting, trading, collecting, rearing, preserving, preliminarily processing or processing a quantity of 30 kilograms or more of critically endangered marine species.

The Decree took effect on November 1 to replace Decree No. 31/2010/ND-CP issued on March 29.

Administrative violations in atomic power

The Government’s Decree 107/2013/ND-CP, dated September 20, 2013, stipulates the sanctioning of administrative violations in atomic energy.

Accordingly, since November 15, 2013, the maximum fine level imposed for individuals shall be VND 1 billion and for organizations shall be VND 2 billion.

New fine levels levied on administrative violations in atomic energy cover scientific study and technology development operation in atomic energy; construction, operation, maintenance, exploitation, management and dismantlement of nuclear facilities, radiation facilities; exploration, exploitation, processing, and use of radioactive ores; production, storage, use, transport, transfer, export, and import of radioactive sources, radiation equipment, nuclear fuel, nuclear materials source, nuclear materials and equipment; processing and storage of radioactive waste and support services serving atomic energy./.
