Gov’t to strengthen prevention of trade remedies evasion, origin fraud

VGP - Prime Minister Nguyen Xuan Phuc has issued a plan to strengthen management and prevention of trade remedies evasion and origin fraud.

The plan aims to protect rights and benefits of Viet Nam in international trade and improve the effectiveness of the free trade agreements to which Viet Nam is a signatory.

Under the plan, the Government will tighten management of export-import and foreign investment activities, improve awareness and effectiveness of implementing regulations on trade remedies, origins, and customs.

The Government will also review, amend and supplement legal documents on prevention of trade remedies and origin fraud while strictly punishing acts of trade remedies evasion and origin fraud.

The Ministry of Trade and Industry shall be responsible for monitoring and updating the lists of goods subjected to anti-dumping and anti-subsidy investigations by foreign countries and report the lists to the Viet Nam Chamber of Commerce and Industry to strengthen control of granting C/O to these kinds of goods.

The Ministry of Planning and Investment and provincial People’s Committees shall have to monitor foreign investment activities, including changes of ownership, mergers and acquisitions, particularly in business domains based on the request of the Ministry of Industry and Trade.

Business associations shall have to inform business members not to abet acts of trade remedies evasion and origin fraud and coordinate with the Ministry of Industry and Trade and the Viet Nam Chamber of Commerce and Industry to organize training courses on origin rules and trade remedies regulations for the business members.

Meanwhile, the Ministry of Public Security shall coordinate closely with the Ministry of Industry and Trade and the Ministry of Finance to examine signs of origin fraud.

The Ministry shall also direct local police force to strengthen supervision and timely detect acts of origin fraud as well as foreign direct and indirect investment in localities.

The number of investigations into trade remedies evasion on Vietnamese exported products has a tendency to increase in recent years, according to Sai Gon Giai Phong Online.
 
By the end of May this year, Vietnamese exported products have had to face 83 cases of anti-dumping, 30 cases of safeguard, 19 cases of anti-dumping duty evasion and 14 cases of anti-subsidy.
 
Besides, authorities have detected that many products imported from other countries or made in foreign countries under outsourcing contracts and labelled "made in Viet Nam" are available in the domestic market or exported to other countries, which have undermined the reputation of Vietnamese exports and deveived local consumers./.
