Investors have rights to claim, accuse and proceed against law breaker

Question (Mr. Trương Đình Lam, Sơn La Province): Some enterprises complete all necessary procedures for the investment registration. However, beyond 15 days as stipulated in Decree 108/2006/NĐ-CP, they receive no investment certificate from the competent agencies. How to solve this case?

Answer (Ministry of Planning and Investment): According to Article 3 of the Government's Decree 108/2006/NĐ-CP dated on September 22, 2006 stipulating in details and instructing the execution of some articles of the Investment Law, within 15 working days since the reception of valid investment and business registration documents, the competent agencies in charge of the issuance of investment certificates must check the documents (in case the applicant wants to found economic organizations to carry out their investment projects) and grant the Investment Certificate without requesting for any other papers. If the agencies violate this regulation, investors can appeal, accuse or proceed against the violators in line with Clause 6, Article 18 of Decree 108/2006/NĐ-CP.
