RESOLUTION

The Government’s regular meeting – January 2013

The Government on January 29 and 30 convenes its regular meeting to discuss and decide the following issues:

1. Reports on the outcomes of the implementation of the Resolution 01/NQ-CP and Resolution 02/NQ-CP, both dated on January 7, 2013, of the Government on key solutions for guiding and directing the realization of the Plan for socio-economic development and state budget estimate in 2013 and solutions for removing difficulties against production and business, supporting the market and dealing with non-performing loans, presented by the Minister of Planning and Investment.

The Government agreed: Ministries, agencies and localities have actively implemented the Resolutions approved by the Party and the National Assembly; the Resolutions No. 01/NQ-CP and No. 02/NQ-CP of the Government; Directives and Official Telegrahp of the Prime Minister on stabilizing market prices, boosting production and preparing for the Lunar New Year holiday. Deposit and lending rates continued to fall down, banking system’s liquidity has been improved; consumer price index increased at the average rate compared to the same period last year; exports continued to experience a robust growth. Agricultural production developed stably, epidemic diseases and poultry smuggling have been better controlled; industrial production rose fairly on a year-on-year basis; service sector continued to witness growth, international arrivals soared. Foreign direct investment and official development assistance climbed up in terms of registered and disbursed volume against the same period last year. Social security has been deployed effectively, particularly the taking care of policy-backed families, people who render meritorious services to the nation, and poor households. Due attention was paid to fields like culture, sports, information and communication, education and training, healthcare, science and technology. Administrative reform, settlement of complaints and denunciations, anti-corruption, thrift practice and anti-wastefulness have been strengthened. Political security and social order have been maintained, the fight against crime has been paid due care and gained positive results; traffic order and safety, prevention of fires and explosions have been enhanced; diplomatic work achieved several results.

However, the Resolutions of the National Assembly and the Government have not been actively and timely carried out in some Ministries, agencies and localities. Difficulties and challenges still remain. Interest rates are high, credit growth is low, non-performing loans have not been basically addressed. Businesses still face numerous difficulties, inventory rates are high in several industries. Damaging cold spells in the North, and droughts in some localities in the Central Region have impacted on industrial production. Part of the population still faces difficulties. Meanwhile, regional and global situation has been complicated, adversely affecting our country’s socio-economic development.

To successfully translate targets, missions set for 2013, the Government requests Ministries, agencies and localities to devote efforts to overcome difficulties and challenges in order to implement key solutions enshrined in the Government’s Resolutions No. 01/NQ-CP and No. 02/NQ-CP dated on January 7, 2013, focusing on the following major tasks:

- To quickly design and promulgate or submit (to competent agencies) documents on concretizing solutions set in the Resolutions No. 01/NQ-CP and No. 02NQ-CP  right in Q1 while actively organizing the implementation of assigned tasks.

- The State Bank of Viet Nam maintains interest rates at proper levels and increases outstanding loans right from the beginning of the year; continues to steer credits to prioritized areas; focuses on directing the handling of bad debts in credit organizations which have converged mature conditions.

- The Ministry of Finance assumes prime responsibility to coordinate with relevant Ministries, agencies to enhance inspection and examination to prevent and punish transfer pricing by foreign-funded enterprises; studies ways to hire foreign prestigious auditing organizations if necessary.

- The Ministry of Planning and Investment assumes prime responsibility to coordinate with the Ministry of Finance and other Ministries, agencies to center on disbursing capital sources allocated for 2013; monitor the disbursement and propose the Government to allocate next year’s capital to key transport projects at proper times. Localities focus on dealing with debts in capital construction within their assigned administration scope.

- The Ministry of Agriculture and Rural Development actively directs the purchase of rice so as prevent prices of rice from falling down, affecting farmers’ incomes; assumes prime responsibility to coordinate with other Ministries, agencies and localities to continue controlling epidemic diseases and preventing livestock and poultry smuggling; works with the Ministry of Information and Communications to provide  the public the news regarding the adequate supply of essential food and foodstuff during the Lunar New Year holiday.

- The Ministry of Industry and Trade assumes prime responsibility to coordinate with other Ministries, agencies and localities to take drastic measures to prevent smuggling, consumption of counterfeit goods and unsafe foodstuff and work with relevant Ministries and agencies to prepare for the 16th round Trans-Pacific Partnership negotiations. Ministries and agencies assigned to prepare negotiation plans and report them to the Government in February, 2013.

- The Ministry of Home Affairs assumes prime responsibility to coordinate with Ministries, agencies and localities to publish administrative reform index; to work with the Ministry of Labor, Invalids and Social Affairs to finalize the Project on reforming policies on salary, social insurance, and preferential treatment to people with meritorious services to the nation in the 2013-2020 and report to the Government for consideration before submitting to the 7th Plenary session of the 11th Party Central Committee.

- The Government Inspectorate carries out inspection tasks and makes public inspection conclusions in accordance with legal regulations while examining, supervising, speeding up and reporting the outcomes of the enforcement of inspection conclusions and the Prime Minister’s instructions regarding the implementation of post-inspection conclusions. Ministries, ministerial-level agencies, Governmental bodies and People’s Committees of provinces and centrally-governed cities, and relevant units and individuals strictly implement inspection conclusions and report the outcomes to the Prime Minister and Chief Government Inspector.

- The Ministry of Information and Communications directs information dissemination work to create social consensus in realizing set objectives and targets; assumes prime responsibility to coordinate with relevant Ministries and agencies to quickly complete the Project on press planning and report it to the Government before submitting to the Politburo. Ministries, agencies and localities actively provide official information to the public, explain about policies and regulatory solutions relating State management within their assigned competence scope, especially issues of greatest public concern; tackle violations in press activities.

- Ministries, agencies and localities center on deploying the Prime Minister’s Official Telegraph No. 03/CD-TTg dated January 3, 2013, No. 201/CD-TTg dated January 30, 2013 on preparation for the upcoming Lunar New Year holiday, ensure necessary conditions for people to enjoy a happy, safe and healthy Tet holiday; focus on ensuring the adequate supply of essential goods to avoid price hikes; pay complement to policy beneficiaries, people with meritorious services to the nation, the poor, forces performing public duties in border and island areas; put a stop to the overload of goods and passenger-carrying vehicles in accordance with the Official Telegraph No. 95/CD-TTg dated on January 10, 2013 the Prime Minister to help people travel conveniently, striving to reduce traffic accidents in three criteria (number of cases, deaths and injuries); enhance prevention and control of fires and explosions and strictly fine acts of storing, trading and transporting firecrackers; maintain political security, social order and safety and ensure people live in security and good health during the Tet holiday.

2. Regarding the Report on information safety and security in State agencies and enterprises, presented by the Ministry of Public Security.

The Cabinet members agreed: Over the past time, State agencies and enterprises have promulgated a number of policies and introduced many solutions, including technical ones to secure information safety and security and protect the State’s secrets. However, technical systems of some agencies and businesses are in danger of loosing control; part of data and documents has been infiltrated, appropriated, and used illegally.

The Government assigns the Ministry of Public Security and the National Steering Committee for information safety to prepare a report on information safety and security in State agencies and enterprises to submit to the Politburo; quickly design action programs or plans to consolidate information safety and security.

The Government approves solutions figured out by the Ministry of Public Security and assigns the Ministry to assume prime responsibility to implement them; requests Ministries, agencies to dignify their responsibility for consolidating information safety and security.

3. Regarding the draft Resolution on some urgent issues of environmental protection, presented by the Minister of Natural Resources and Environment.

Over the past years, to work towards sustainable development, the Party and the Government have always paid due attention to socio-economic development in association with environmental protection and improvement with positive outcomes. However, along with socio-economic development, environmental issues are generating complicated corollaries: the quality of the environment degrades, environmental pollution increases, many areas have been extremely polluted, especially in industrial clusters and parks, mineral exploration sites, craft villages, big cities, river basins and rural areas. Uncollected and absolutely untreated wastewater, solid wastes and medical wastes, etc have imperiled public health and hindered national sustainable development.

The Government unanimously agreed on groups of tasks and solutions proposed by the Ministry of Natural Resources and Environment to overcome the above issues. The Ministry of Natural Resources and Environment is assigned to assume prime responsibility to coordinate with the Office of Government and relevant agencies to collect the Cabinet members’ comments on and finalize the draft Resolution on some urgent issues of environmental protection, then submit it to the Prime Minister for issuance in February 2013.

4. Regarding preferential treatment policies for those are delegated to study atomic energy, presented by the Minister of Education and Training.

The Government passed the guideline to provide incentives and support for tertiary education establishments as stipulated in the Prime Minister’s Decision 1558/QĐ-TTg dated August 18, 2010, and for people who are delegated to study atomic energy field inside and outside the country in accordance with orientations presented by the Ministry of Education and Training at this [Government’s regular] meeting.

The Ministry of Education and Training assumes prime responsibility to coordinate with the Ministry of Justice, the Office of Government and relevant Ministries, agencies to collect the Cabinet members’ comments on, finalize the draft Resolution and submit to the Government to put the Resolution into effect since school year 2013-2014.

5. For reporting outcomes of the Government’s accountability session regarding the promulgation of bylaw documents guiding the implementation of laws and ordinances, presented by the Minister of Justice before the National Assembly’s Law Committee.

          The Government requests Ministries and agencies to collect the National Assembly’s Law Committee’s comments at the accountability session; learn from the shortcomings of legal building and promulgation of bylaw documents guiding the implementation of the laws and ordinances while overcoming shortcomings in institutional building as pointed out in the Government’s Report No. 09/BC-CP dated January 9, 2013 on reviewing the Government’s performance in 2012; to quickly review, amend, abolish, supplement improper regulations raised by National Assembly law-makers at the accountability session; to focus on implementing synchronous solutions to heighten the quality of legal building work as proposed by the Ministry of Justice in its Report No. 23/BC-CP dated January 25, 2013.

6. Regarding bills: Law on amending and supplementing some articles of the Law on Fire Prevention and Fighting, Law on amending and supplementing some articles of the Law on Corporate Income Tax, Law on amending and supplementing some articles of the Law on Value-added Tax, Law on amending and supplementing some articles of the Law on Emulation and Commendation, and Law on Citizen Reception, submitted by the Minister of Public Security, the Minster of Finance, the Minister of Home Affairs, and the Chief Government Inspector.

The Ministry of Public Security and Government Inspectorate are responsible for coordinating with the Ministry of Justice, the Office of Government and relevant agencies to collect the Cabinet members’ comments on and finalize the Law on amending and supplementing some articles of the Law on Fire Prevention and Fighting; the Law on Citizen Reception. The Minister of Public Security and the Chief Government Inspector, assigned by the Prime Minister, act on behalf of the Government to submit these bills to the National Assembly.

The Ministry of Finance assumes prime responsibility to coordinate with relevant Ministries, agencies to collect the Cabinet members’ comments on and continue to finalize the Law on amending and supplementing some articles of the Law on Corporate Income Tax, the Law on amending and supplementing some articles of the Law on Value-added Tax, then report them to the Prime Minister.

The Ministries of Home Affairs assumes prime responsibility to work with relevant Ministries and agencies to collect the Cabinet members’ comments on and continue to finalize the Law on amending and supplementing some articles of the Law on Emulation and Commendation, then report it to the Prime Minister.

7. Regarding draft documents: The Ordinance on national defense work at Ministries, Ministerial-level agencies, Governmental bodies, and localities; the Ordinance on amending and supplementing some articles of the Ordinance on management and use of weapons, explosive materials, and supporting tools, submitted by the Minister of National Defense and the Minister of Industry and Trade.

The Ministry of National Defense and the Ministry of Industry and Trade assume prime responsibility to coordinate with the Ministry of Justice, the Office of Government and relevant agencies to collect the Cabinet members’ comments on, finalize draft documents: the Ordinance on national defense work at Ministries, Ministerial-level agencies, Governmental bodies, and localities; the Ordinance on amending and supplementing some articles of the Ordinance on management and use of weapons, explosive materials and supporting tools. The Minister of National Defense and the Minister of Industry and Trade, authorized by the Prime Minister, act on behalf of the Government to submit these documents to the National Assembly Standing Committee./.
