RESOLUTION

The Government’s regular meeting – July 2006

On 31 July and 1 August 2006, the Government held the regular meeting (July 2006) to discuss and decide on the following issues: 

1. About the Government’s Action Program to implement the Resolution of the 10^th Party Congress and the Resolution of the 9^th Session of the 11^th National Assembly on the Five-year Plan on Socio-economic Development 2006-2010, the Government discussed and came to the conclusion: This Action Program was the concretization of targets and contents of the Resolution of the 10^th Party Congress and the National Assembly’s Resolution on the Five-year Plan on Socio-Economic Development 2006-2010 into the program to set up legal documents, regimes, policies, projects and works within the Government’s and the Prime Minister’s competence, with the clear division of responsibilities and the specific implementation process, as the foundations for the Government’s direction and management, the executive agencies’ performance, and the competent organs’ supervision and examination in order to realize and successfully fulfill all goals set by the Socio-economic Development Plan.

The Ministry of Planning and Investment was entrusted to direct and coordinate with the relevant agencies to receive all suggestions in the meeting and complete the drafting of the Governmental Resolution on the Action Program to implement the Resolution of the 10^th Party Congress and the National Assembly Resolution on the Five-year Plan on Socio-economic Development 2006-2010, then submitting to the Prime Minister to decide on the issuance.

The Ministries, sectors and localities should set up their own action programs to concretize the Government’s Action Program and clearly define their programs, plans, and projects within their competence, which should be effectively realized in line with the set process.

2. The Government discussed and approvevd the Bill on Produce and Commodity Quality presented by the Minister of Science and Technology; the Bill on the Prevention and Eradication of Infection Diseases submitted by the Minister of Health; the Bill on Vietnamese Territorial Waters posed by the Minister of Foreign Affairs; and the Draft Ordinance on Protecting Important Targets of National Security presented by the Minister of Public Security.  

The Government basically agreed on the contents of these bills and ordinances. The ministries proposing the above projects were commissioned to coordinate with the Ministry of Justice, the Governmental Office and other relevant agencies to collect opinions in the meeting, fulfill each project, clartify differences, and report to the Prime Minister for considering and deciding on the submission to the National Assembly Standing Committee.

3. The Government discussed and approved the following resolutions and decrees:

a) To supplement some articles of Decree 132/2005/NĐ-CP dated 20 October 2005 by the Government on rights and obligations of State owners over State-run companies in conformity with the suggestions made by the Minister of Planning and Investment. The Governmental Office should collect all opinions in the meeting and perfect the draft decree before submitting to the Prime Minister for signature and issuance.

b) To approve the Government’s Draft Decree stipulating direct investments to other countries submitted by the Ministry of Planning and Investment, in which Item 2 Article 4 in the Draft would be cut down. The Governmental Office would receive the comments in the meeting, complete the Draft and submit it to the Prime Minister for signature and issuance.

c) To approve the contents of the Resolution on some measures to speed up the schedule of selling the State-owned houses to the renters as stipulated by Decree 61/CP dated 5 July 1994. The Governmental Office should direct and coordinate with the Ministry of Construction and the Ministry of Resources and Environment to complete the Draft Resolution and submit it to the Prime Minister for signature and issuance.

d) For the Draft Decree on Science and Technology Enteprises: the Ministry of Science and Technology was assigned to direct and coordinate with the Governmental Office and the relevant agencies to further improve the Draft Decree and send to the Government members for comment, then report to the Prime Minister for consideration and decision.

4. The Government listened to the report in the negotiations for Vietnam’s entry into WTO presented by the Minister of Trade.

The Government entrusted the relevant ministries and agencies as well as the Government’s Negotiation Team to deal with all unsolved issues, promote multilateral and bilateral negotiations with different partners to be able to end the negotiation process on schedule set by the Working Board on Vietnam’s accession to WTO. The Minister of Trade would be authorized by the Prime Minister to report to the National Assembly Standing Committee about the results of multilateral negotiations, set up the accession route and submit to the National Assembly Standing Committee to consider and put into the agenda of the 10th session of the National Assembly in order to approve the results of the negotiations on WTO accession; to direct and coordinate with the relevant agencies to prepare the Government’s Statement on this work and submit it to the President for consideration and submission to the 10th session of the National Assembly; to direct and coordinate with the relevant ministries and agencies in building the action program to realize WTO accession commitments, which should be submitted to the Government for approval in the regular meeting in October 2006.

The Government agreed in principle to publicize general information about multilateral and bilateral commitments to people and enterprises. The Ministry of Trade, the Ministry of Finance and the relevant agencies should promptly implement this work. The relevant ministries and sectors should make plans to mobilize, attract, allocate and use effectively foreign technical aids to realize the WTO accession commitments.

5. The Government discussed the Report presented by the Governmental Office on setting up and issuing documents stipulating and instructing the implementation of laws and ordinances.

Over the past years, the building and issuance of documents stipulating and instructing the implementation of laws and ordinances has gained significant achievements, helping to promote socio-economic development, and solidify State management in all fields. However, this work is now quite slow, with low quality, so some legal documents and ordinances have slowly put into effect after their issuance.

To soon overcome this situation, the Government requested the ministries and sectors to consider this an important work which should be regularly and continuously directed. The Government agreed basically on the solutions proposed by the Governmental Office; and entrusted the Governmental Office to direct and coordinate with the relevant agencies to submit to the Prime Minister for issuing the direction on enhancing the building and issuing documents stipulating and instructing the implementation of laws and ordinances; at the same time, to submit to the Prime Minister the regulations on sequence and procedures to set up and issue legal documents within the Government’s and Prime Minister’s competence.

6. The Government considered the report on socio-economic situation and the report on the results of production, business, services and investment in July and the first seven months of 2006, submitted by the Ministry of Planning and Investment; the report on commercial situation in July 2006 presented by the Ministry of Trade; the report on inspecting and solving complaints and denunciations in the second quarter of 2006 submitted by the Governmental Inspection.

In July and the first seven months of 2006, the economy have continued to develop. The industrial production value have increased higher than the same period of last year; agricultural production has developed sustainable, the bird flu has been controlled fruitfully; the “toe-and-mouth” epidemic among cattle has been constrained. The total commodity retail and service revenue, tourism, cargo and passenger transportation, post and telecommunication, etc. have all increased higher than last year. Export turnover have continued to go up; in which key commodities have reached a much higher growth rate than the same period of 2005. The trade gap has been narrowed compared to the same period. The attraction of foreign investment capital has risen considerably; State budget collection and spending have been carried out on schedule. Monetary and banking activities have been stabilized. The consumption prices have increased insignificantly in comparison with the same period. Social order and national defense and security have further been maintained. Education and training, health care, job generation, culture, sports and physical culture, care for the beneficiaries of social policies, poverty alleviation; inspection and dealing with complaints and denunciations have been carried out in line with the plan set up in the early 2006, bringing about the positive shifts.

However, in July and the first seven months of 2006, some difficulties and challenges have arisen: the capital resources, especially the State bond capital and investment credits, have been reimbursed slowly. The import price of essential production materials has fluctuated. Climatic conditions and epidemics have changed unusually, causing negative impacts on production and people’s life; traffic accidents have been reduced but the number of kills and injuries still remains high. Smuggling, trade frauds, corruption and prodigality, and social evils have not been effectively prevented and eradicated.

To fulfill the Socio-economic Development Plan 2006, the Government requested the ministries, sectors and localities to follow the realities and direct thoroughly the implementation of Resolution 01/2006/NQ-CP dated 16 January 2006 by the Government on major solutions to direct and manage the realization of the socio-economic development and State budget plan 2006, Resolution 13/2006/NQ-CP dated 7 July 2006 and other resolutions by the Government; boost production and thrift practice, reduce production costs, improve the competitiveness of commodities and services; promote exportation, control market prices and price increases; solidify the management of investment and budget use; promote the inspection, examination and supervision of the realization of the investment projects, public works, anti-prodigality, corruption eradication; reduce traffic accidents; actively prevent and cope with natural disasters; prevent the bird flu. Ministries, sectors and localities should direct social work, especially the preparation for the new school year; timely deal with complaints and denunciations to prevent the prolonged cases. To further enhance the administrative reform, the accession to the WTO, and prepare all necessary conditions for successfully organizing the APEC Summit in November./.
