5th edition of land law covers new important points

VGP – The 5th edition of the Land Law, which is now open for public comments, consists of a number of new important points, according to the Ministry of Natural Resources and Environment.

The 5th edition of Land Law is expected to better protect legitimate interests of vulnerable groups, including ethnic minorities

The draft document stipulates more clearly and specifically the responsibilities of the State as land ownership representative for uniform management of land and rights and obligations of land users.

The rights and obligations of land users are also improved in accordance with subjects and forms of land use.

Duration of land use in agricultural sector shall be expanded and regulations on land for rice cultivation may also be included.

The State shall limit land allocation cases while land lease forms shall be encouraged. Land prices shall be decided by the market. This aims to gradually abolish subsidies in land management and use.

The bill covers legal framework to build land information system in a bid to increase transparency in land management and use and corruption prevention.

The legal framework is also expected to secure people’s rights to access to land information, enhance their supervisory role during the making and implementation of land use planning schemes as well as compensation and resettlement process.

The State shall limit land recovery for socio-economic development projects and cases for compensation shall be clearly stipulated.

To protect the legitimate interests of vulnerable groups like women, the poor, ethnic minorities, the names of both husbands and wives shall be written on Certificate of land use rights.

The Ministry of Natural Resources and Environment said the above new aspects would help reduce land-related petitions, corruptions and wastefulness, improve State management capacity and better exploit land resources for socio-economic development./.
