Five laws to take effect next month

VGP – Five Laws on Land, Anti-Wastefulness, Bidding, Reception of Citizens and Anti-Fire will come into effect since July 1, 2014.

The State administers the land on behalf of the people as a whole

The revised Land Law, cónisting of 14 chapters and 212 articles, clearly regulates the State’s rights, obligations and its role in land management.

The State has the right to decide on land planning; land use planning schemes; the amount of land allocated to a household; land tenure; land allocation decisions; land lease and certificates on land use rights; decisions to acquire land for the purposes of national defence, national security and socio-economic development for the national interest and for the public and others.

The 2013 Land Law devotes the entire Chapter XI on the rights and obligations of land users. Under the law, land users have their right to transfer their land use rights and the duty to implement all rights and obligations written in the law. Their land use rights are protected by the law. Land use rights also included the rights to transfer, exchange, lease, inherit and mortgage.

Regarding land users' obligations, the law states that the land must be used in accordance with the content specified in the certificate of land use rights; and the users have to register their land with the authorities.

In case they want to transfer their land use rights to others, they have to complete all required procedures and financial responsibilities.

Regarding compensation, support and resettlement, the law clearly specifies that compensation must be decided by the Provincial People's Committee at the time that land is taken; the support is aimed to stabilise the lives of affected people, including production, occupational training and employment, among others.

On land prices, the law says that the land price is based on the use of land specified on the land use certificate, land tenure and to remain close to the market price or the income generated from the land.

The land price table is changed every five years and adjusted when there is a large change in the market.

The Law on Thrift Practices and Anti-Wastefulness

With five chapters and 80 articles, the amended Law on Thrift Practices and Anti-Wastefulness stipulates scopes of adjustment on thrift practices and anti-wastefulness in management and spending of State budget, public assets, labor, time of working in State sector, exploitation and usage of natural resources, production and business activites.

The fresh law adds some regulations on uncovering wastefulness, preferential mechanisms for organizations and individuals to provide timely information on the field.

The law perfects mechanisms to combat wastefulness via investigation, auditing as well as inspection.  

Generating opportunities for domestic bidders

The Law on Bidding was adopted on November 26, 2013 with 13 chapters and 96 articles.

The new law gives a priority to human resource development and opportunities for domestic bidders and workers.

It targets to support Vietnamese bidders to receive advanced technology and management experience to edge their competence and competitiveness to handle large-scale projects.

The law regulates assessment of dossiers of invitations on specific fields and prohibits low-cost bidding.

It also consists of regulations on banned acts and dealing with breaches of bidding.

Heightening responsibilities for reception of citizens

The Law on Reception of Citizens includes nine chapters and 36 articles, requiring agencies and organizations to organize the reception of citizens in line with its duties and functions.

The new law enhances responsibilities of leaders of agencies and organizations in reception of citizens.

Strengthening State management on fire prevention

The Law on Fire Prevention and Fighting includes nine chapters and 65 articles, clarifying responsibilities of leaders of organizations, agencies, householders and individuals in investigating and supervising regulations on fire prevention and fighting.

The law adds additional regulations on service of fire alarming and fighting./.
