RESOLUTION

The Government’s regular meeting – September 2006

 

The Government’s regular meeting (September) on 2 October 2006 discussed and decided on the following issues:

1. The Government listened to the report of the Minister-Head of the Governmental Office on the development of Hurricane 6 and its damages.

Hurricane 6 was a fierce storm hitting the Central Vietnam on 1 October. Thanks to accurate forecast, the Government’s timely, resolute and consistent direction and different sectors’ and localities’ great efforts in preventing and coping with the hurricane, its damages and negative impacts have been minimized.

To further cope with and overcome its impacts, the Government requested the provinces in the Central Highlands and the northern part of Central Vietnam where there are many big rivers, to actively prevent and fight against inundation, sweeping flood, and landslide; the provinces of Thừa Thiên-Huế, Đà Nẵng, Quảng Nam, and Quảng Ngãi should mobilize their forces to overcome damages and support victim families, not leaving people in hunger, coldness, epidemic and without accommodation; the Ministries, sectors and localities should send their working teams to inspect the situation and propose proper solutions, promptly restoring production and stabilizing people’s life.

2. The Government considered the draft Decree on Organization and Operation of Forest Management submitted by the Ministry of Agriculture and Rural Development; and listened to the Minister-Head of the Governmental Office summarizing the Government members’ opinions about the draft Decree.

Forests play an important role in the national economy and the society’s life. To create a legal mechanism to renew the organization and operation of the forest management force, meeting the real demands, solidifying the State management in forest protection and development, the issuance of the Governmental Decree on Organization and Operation of Forest Management is very necessary. On the requirements of the administrative reform of the uniform management and operation in the work of forest protection and development, the Provincial Branch of Forest Management should be organized and administered by the Services of Agriculture and Rural Development.

The Ministry of Agriculture and Rural Development was assigned to direct and cooperate with the Ministry of Internal Affairs, the Governmental Office and other relevant agencies in collecting all opinions in the meeting, then completing the Draft Decree and submitting it to the Prime Minister for consideration, approval and issuance.

3. The Government also heard the Minister of Finance’s statement on the Bill on Individual Income Taxation and the Minister-Head of the Governmental Office’s report on summing up the Government members’ opinions on this bill.

To continue the institutionalization of the Party’s guidelines and the State’s policies; to promote the control work, income distribution and macro regulation over the socio-economy; to overcome shortcomings and perfect the system of taxation policies in order to meet the requirements of socio-economic development and international economic integration in the time to come; to contribute to the maintenance of stability and create resources for the State budget, the issuance of the Law on Individual Income Taxation is a necessity.

The Ministry of Finance was assigned to cooperate with the Ministry of Justice, the Governmental Office and other relevant agencies to accept all opinions at the meeting, which should be used to perfect the Bill on Individual Income Taxation. The Minister of Finance should be authorized by the Prime Minister to submit this Bill to the National Assembly.

4. The Government considered the Draft Ordinance on Practising Democracy in Communes, Wards and Towns submitted by the Ministry of Internal Affairs; the Minister-Head of the Governmental Office also presented his summary report on the Government members’ opinions about this Draft Ordinance.

To concretize the Party’s guidelines on bringing into play the people’s direct mastership at the grassroots level and realize the motto “people know, people discuss, people do, people inspect”, the Government issued Decree 29/1998/NĐ-CP dated 11 May 1998 which was later replaced by Decree 79/2003/NĐ-CP dated 7 July 2003 promulgating the Statutes on the Practice of Democracy at Communal Level. When be implemented, the Statutes helped to bring about practical effects. However, there remained many shortcomings and restrictions in the contents and implementation which required to be corrected in order to raise the Statutes’ legal coerciveness.

The Ministry of Internal Affairs was commissioned to direct and cooperate with the Ministry of Justice, the Governmental Office and other related agencies to receive all comments and perfect the Draft Ordinance on Practising Democracy in Communes, Wards, and Towns which should be submitted to the Prime Minister for consideration and decision before submitting it to the National Assembly’s Standing Committee.

5. The Government also considered the Draft Ordinance to amend and supplement some articles in the Ordinance on Criminal Investigation Organization submitted by the Ministry of Public Security; and listened to the Minister-Head of the Governmental Office’s summary report on the Government members’ comments on this draft ordinance.

The Ordinance on Criminal Investigation Organization was issued in 2004 and became a legal instrument for investigation offices to timely discover, inspect, and deal with all criminal actions; better ensuring people’s freedom and democracy; maintaining national security and social safety. However, the Ordinance has showed some difficulties in the investigation security agencies’ competence, in the organizational system of the investigation police offices and the sector’s superiors’ power to assign investigation tasks. To timely solve these difficulties and implement the Law on Corruption Prevention and Eradication by founding the specialized units in charge of corruption eradication, it is essential to amend and supplement the Ordinance on Criminal Investigation Organization.

The Ministry of Public Security was assigned to direct and coordinate with the Ministry of Justice, the Governmental Office and the relevant agencies to accept all comments in the meeting and perfect the Draft Ordinance to amend and supplement some articles of the Ordinance on Criminal Investigation Organization, then submitting it to the Prime Minister for consideration and decision before the submission to the National Assembly Standing Committee.

6. The Government listened to the report of the Minister-Head of the Governmental Office on the realities of setting up and issuing the documents to stipulate and guide the implementation of laws, ordinances and resolutions made by the 11th National Assembly and the NA Standing Committee. In the meeting, the Minister of Planning and Investment also reported the results of production, business, service and investment in September and the socio-economic situation in the first nine months of 2006.

To speed up the setting up of documents necessary for the negotiations for the accession to the World Trade Organization (WTO) and thoroughly grasp Direction 31/2006/CT-TTg dated 25 August 2006 by the Prime Minister on promoting the drafting and issuance of documents stipulating and instructing the implementation of laws and ordinances, over the past time, the ministries and competent agencies have promptly drawn up, examined and verified documents. This work has achieved some significant changes but not fulfilled the fixed plans. The Government requested the Ministers and leaders of the relevant agencies to further direct the drafting of documents as assigned by the Government, ensuring both the quality and schedule.

In the first nine months of 2006, the socio-economic development has been stabilized. The economic growth rate is relatively high, reaching 7.84 per cent. A fairly high growth rate has been obtained in industrial agriculture. Agirculture has developed quite sustainably. Some achievements have been obtained in attracting social investment capital, especially FDI and people’s capitals. The export market has been broadened, and export turnover growth rate is quite high. Domestic markets continue to develop, the rate of consumption price increase is reduced against the same period of last year. Many progresses have been made in social activities: the school year 2006-2007 launched; epidemic prevention and eradication speeded up; many cultural and information activities carried out.

To effectively deal with difficulties and challenges in the last months, fulfilling and exceeding the plan on socio-economic development in 2006, the Government requested the ministries, sectors and locaties to continue the realization of socio-economic development solutions put forward in the Government’s resolutions and the Prime Minister’s instructions; to clarify the reasons of low growth in some economic sectors and take proper measures; to speed up the disbursement of investment capital for fundamental construction; to facilitate the development of the sectors and fields with opportunities to extend their markets and increase their production capacity; to strengthen many measures to prevent and fight against epidemics and natural calamities; to put forward solutions to restrain price escalation and promote the price readjustment in line with the market mechanism, abolishing subsidies and compensation for losses; to reduce traffic accidents; to settle people’s complaints; and to proactively do preparatory work for the WTO accession and the successful organization of APEC Summit./.
