Gov’t to impose tougher punishments on labor infringements

VGP – Since June 25, actions violating the Labor Code will be fined from VND 200,000 to VND 30 million.

Enterprises employing foreign laborers but not informing the recruitment number to the local Department of Labor, War Invalids and Social Affairs will be fined VND 20-30 million.

The regulation is stipulated in Decree 47/2010/NĐ-CP of the Government on administrative punishments for labor infringements.

Under the Decree, individuals or organizations breaking the labor regulations will be warned or imposed pecuniary penalties. Noteworthy, enterprises, employing foreign laborers but not informing recruitment number to the local Department of Labor, War Invalid and Social Affairs ,will be fined VND 20-30 million.

In addition, supplementary punishments may be the revocation of business licenses or seizure of facilities which are used to breach the laws.  

Besides administrative punishments as well as supplementary penalties, law-breaking organizations and individuals will have to compensate for their wrongdoings such as returning deposits for laborers or repairing machines and equipment in poor quality.

Foreign laborers, working in Việt Nam over three months without labor certifications or having expired labor certifications, will be expelled. 

The Decree is null and void to any infringements in the areas of vocational training, sending of laborers abroad under contracts, and social insurance./.
