Ten laws to take effect since early January

VGP – The laws on tertiary education, union, deposit insurance, pricing, legal dissemination and education, judicial assessment, advertising, water resources, anti-money laundering, and sea of Viet Nam will take effect since January 1, 2013.

Tertiary Education Law

The law, comprising 12 chapters and 73 articles, is expected to strengthen supervision of the quality of education and training. 

Its governing scope includes the classification, socialization of tertiary education, self-control of tertiary establishments, and education quality control.

The law covers provisions on strictly monitoring students’ learning records and on minimum standards of knowledge and skills.

Verifying the quality of education is compulsory and the ranks of tertiary establishments will be decided thereof.

Union Law

With 33 articles, this law consists of new provisions pertaining to the clarification of responsibilities of State agencies, units and businesses as well as dispute settlement mechanism.

Trade union fee is equal to 1% of the salary and wage fund paid by State agencies, organizations and businesses to laborers.

Deposit Insurance Law

Under the law, the State Bank of Viet Nam is responsible for exercising State management over deposit insurance.

Deposit insurance shall only be applicable to individuals.

Pricing Law

The law stipulates list of goods subjected to price stabilization, including petroleum, power, liquefied natural gas, nitrogenous fertilizer, plant protection chemicals, milk for children under six years old, rice among others.

Legal Dissemination and Education Law

Under the law, November 9 is chosen to be the Viet Nam Legal Day to honor the Constitution and laws, educate the sense of legal observation for citizens.

This is also the date that the National Assembly adopted the country’s first Constitution in 1946.

Law on Judicial Assessment

According to the law, there will be two types of judicial assessment organizations, public and non-public ones. It reflects the country’s effort to mobilize social resources for judicial appraisal.

Non-public judicial assessment organizations shall be allowed to operate in the fields of finance, banking, construction, antiquity, relics, and copyright.

Advertising Law

The law prohibits the advertisement of certain kinds of goods and services, including tobacco, wine with alcohol concentration above 15%, milk for children under 24 months, nutritional products for children under six months, prescribed drugs, aphrodisiac commodities, shotguns, and sporting weapons.

Water Resources Law

Comprising of 39 new articles and other 40 amended ones, the law clearly stipulates measures to prevent pollution, degradation, exhaustion; respond to and overcome water pollution and others.

All activities of water exploitation shall have to comply with water resource planning schemes.

Construction of new hospitals, medical establishments, cemeteries, waste-burial sites in the water resource protection corridor will also be banned.

Anti- Money Laundering Law

The adoption of the law, expected to make the national financial system more transparent, is part of Viet Nam’s effort to improve legal foundation for anti-money laundering activities in the country.

Law on the Sea of Viet Nam

With 7 chapters and 55 articles, the law is an important step to perfect legal framework relevant to the country’s sea and islands.

This is the first time, Viet Nam has a law which fully covers the legal status of sea and islands under its sovereignty and sovereign rights in accordance with the 1982 UN Convention on the Law on the Sea.

All organizations and individuals must respect the sovereignty, territorial integrity, sovereign rights, jurisdiction and interests of Viet Nam, comply with Viet Nam’s legal regulations while conducting activities in our country's sea areas./.
